Surrogacy Law Aims to Prevent Exploitation, Rejects India as 'Renting a Womb' Industry : Delhi HC

Recently, the division bench comprising Acting Chief Justice Manmohan and Justice Mini Pushkarna of the Delhi High Court emphasized that the surrogacy regulations aim to prevent the exploitation of surrogates, highlighting the collective disinterest in India becoming a hub for what it termed the "renting of wombs" industry.

“This is a beneficial act and it is primarily intended to curb the exploitation of surrogates. India is still a developing country and it’s not a fully developed country. Because of economic reasons many people may be swayed towards this and CII (Confederation of Indian Industry) in one of its reports is supposed to have stated that India at one point of time was a 2.3 billion dollar industry,” the bench said.

The petitioners' counsel clarified that the petitioners were Indian citizens temporarily residing in Canada for work reasons. In response, the bench suggested that they could consider utilizing surrogacy services in Canada itself.

"The reason they come to India is due to the economic disparity, where individuals can rent a womb. However, it's crucial that our country doesn't evolve into an industry solely focused on this practice. This isn't the industry we aim to endorse. The legislature has taken a decisive stance on this matter," stated the bench
