Supreme Court rejects PIL Challenging Darwinian Theory of Evolution

Today, Supreme Court rejected a PIL challenging the Darwinian theory of evolution and Einstien's equation.

A division bench of Justices Sanjay Kishan Kaul and Sudhanshu Dhulia in its order said :

“The petitioner wants to prove that Darwinian theory of evolution and Einstein's equation are wrong and he wants a platform for the said purpose. If that is his belief, then he can propagate his own belief.''

''This cannot be a writ petition under article 32 of the Indian Constitution, which has to deal with the issues of fundamental rights.”

At the outset of the hearing, the Petitioner, representing themselves, presented their argument

“… I have studied in my school time and college time and today I say that whatever I studied was wrong”

To its response, the Bench said -

''Then you improve your theory…what is the Supreme Court supposed to do. The Supreme Court cannot intervene in such matters. You claim to have studied these theories as a science student, but asserting their incorrectness does not give rise to a violation of your fundamental rights under Article 32.”

Further, the bench said -

 ''Supreme Court will not say that you prove that Newton is wrong or Einstein is wrong. This is 32 petition. Who is the Counsel who has filed it?

“You do your own theory and propound it. No difficulty. You feel that two theories existing for a long time are wrong….you propagate your own theory”

Following this, the petitioner attempted to persuade the Bench by asserting that 20 million people have died due to their acceptance of Darwin's theory.

However, Justice Kaul explicitly declared that these are not rights that fall under adjudication.
