Supreme Court permits Medical Student to join counselling without original documents

Giving relief to a Medical Student competing for NEET-PG 2022-23, the Supreme Court permitted her to participate in the counseling schedules to be this week in terms of the notification dated 19.10.2022 and further directed to facilitate her joining without insisting upon the original documents if she cracks the counseling.

A bench of Justice Ajay Rastogi and CT Ravikumar issued notice to Medical Counseling Committee and noted that "she appeared in the (NEET) Examination of 2021-2022 in the first instance and in order of merit she joined post-graduate course in MS (Oto-RhinoLaryngology) of three years duration at Kasturba Medical College, Manipal on 24.02.2022 as a Junior Resident but she wanted to join post-graduate course in other disciplines of her choice so she later appeared in post-graduation NEET examination (2022-23). However, she qualified in the competitive test and is inclined to appear in the second counseling to be held from 26.10.2022 to 30.10.2022 in terms of the Notification dated 19.10.2022."

Noting the apprehension of the petitioner, the bench observed that "if she gets allotment in the second round of counseling, they will demand to furnish the original documents which she has surrendered to Kasturba Medical College, Manipal where she earlier joined on 24.02.2022 and since they are asking her to furnish the balance tuition fee of two remaining years in terms of the Bond furnished, she is unable to comply with, that is the reason for which she has approached this Court by filing this petition."

The Bench issued notice and directed the matter to be listed on 25.11.2022 for further hearing after the respondents put their appearance.
