Supreme Court Dismisses Plea Against Release of Alia Bhatt's Film 'JIGRA'

The Supreme Court of India today declined to entertain a Special Leave Petition (SLP) challenging a Rajasthan High Court order that had stayed a lower court's ruling, which in turn had halted the release of Alia Bhatt's film JIGRA.

A Commercial Court in Jodhpur had previously stayed the film's release due to a trademark violation claim.

However, a bench comprising Chief Justice DY Chandrachud, Justice JB Pardiwala, and Justice Manoj Misra noted that the film had already premiered and therefore refused to intervene in the matter.

The petitioner, Bhallaram Choudhary, argued that he operates an online education platform named "Jigar Education" and had obtained a trademark for it under The Trade Marks Act, 1999, in September 2023, classified under Class 41, which pertains to education, entertainment, and training. He sought to halt the film’s release, claiming it violated his trademark rights.

In response, CJI Chandrachud remarked, "What can we do when the movie is already released? I hope it is doing well because of this."

Senior Advocate A.M. Singhvi, representing Dharma Productions, contended that the petitioner's coaching institute bore no relation to the film.

"Posters were put up in September. 90 crores of investment made, the petitioner has a certificate for education, mine is motion pictures..", Singhvi further told court.
