Supreme Court Acquits Death-Row Inmate in 2012 Pune Triple Murder Case

On Thursday, the Supreme Court acquitted a death-row inmate convicted in a triple murder case that occurred in Pune in 2012.

A Bench consisting of Justices BR Gavai, Prashant Kumar Mishra, and KV Viswanathan emphasized that the conviction was founded on circumstantial evidence.

"Since it is a case of circumstantial evidence where the prosecution has failed to prove guilt beyond reasonable doubt, we have allowed the appeal."

The verdict came as the convict challenged a July 2019 ruling by the Bombay High Court, which upheld the death sentence for the murder of his mother, wife, and two-year-old daughter in 2012. A Pune trial court had initially convicted him and sentenced him to death in 2016.

The Supreme Court admitted his appeal in January 2020 and reserved its judgment on September 25 this year. The accused was found guilty of killing his family members, allegedly in response to their objections regarding his extramarital affair with a colleague.

After the murders, the convict claimed to the police that his mother, wife, and child had been killed during a theft at their home. However, investigators deemed his account implausible, noting the absence of any stolen items or signs of forced entry. Additionally, they found it suspicious that an elderly neighbor had sustained injuries, later discovering that the accused had attacked him to prevent him from reporting the crime.

The High Court characterized the case as a cold-blooded murder, confirming the lower court's death sentence and categorizing it as one of the "rarest of the rare" cases. Nevertheless, it stayed its ruling pending the outcome of the Supreme Court appeal, in accordance with Section 415(1) of the Criminal Procedure Code.

Before the Supreme Court, the convict was represented by Advocates Payoshi Roy, K Paari Vendhan, Siddhartha, S Prabu Ramasubramanian, Bharathimohan M, Santhosh K, P Ashok, and Manoj Kumar A. The State of Maharashtra was represented by Advocates Siddharth Dharmadhikari, Aaditya Aniruddha Pande, Bharat Bagla, Sourav Singh, Aditya Krishna, Preet S Phanse, Adarsh Dubey, and Yamini Singh.
