Subramanian Swamy Moves Delhi HC, Seeks MHA Decision on Cancelling Rahul Gandhi's Indian Citizenship

Bharatiya Janata Party (BJP) leader Subramanian Swamy has petitioned the Delhi High Court, requesting that it direct the Ministry of Home Affairs (MHA) to decide on his representation for revoking the Indian citizenship of Congress leader and Lok Sabha Leader of Opposition Rahul Gandhi.

The plea is expected to be heard by the High Court next week and has been filed through advocate Satya Sabharwal.

Swamy's petition, dated 2019, alleges that a company named Backops Limited, registered in the UK in 2003, listed Gandhi as a Director and Secretary. According to Swamy, Gandhi declared his nationality as British in the company's Annual Returns filed on October 10, 2005, and October 31, 2006, and also in the company's dissolution application dated February 17, 2009.

Swamy contends that these declarations violate Article 9 of the Indian Constitution and the Indian Citizenship Act, 1955. Despite the MHA requesting clarification from Gandhi on April 29, 2019, Swamy argues that there has been no decision or clarity from the MHA in the over five years since.
