When the Senior Advocate Designation Case was mentioned before the Court No.2 of the Supreme Court comprising Justices Sanjay Kishan Kaul and Abhay S. Oka, the bench remarked orally that "The system should not be structured for someone and it shall not be de-structured for someone".
Justice Kaul also remarked that there are certain guidelines issued by the court in the same matter and it requires further finetuning. The Court also said that "We get wiser by experience" and the experience we have earned while in the process of designation, we shall fine-tune the process.
Justice Kaul also expressed his concern regarding the numbers given for the Article Publication since sometimes they are being written by their junior advocates and published in the name of the people applying for the designation.
Justice Oka interjected in between and said that the system is also required to be finetuned since there are a lot of applications and the reading of judgments consumes a lot of time. he said that it took about 4 hours to read the judgment of one candidate and there are more than 300 applicants.
The bench also discussed the marks given in the interview which has a high percentage.
on the lighter side justice Kaul remarked orally that some of the advocates have complained about the system that with the new system "it is easier to become a judge than getting designated as a senior advocate"
The case is listed tomorrow before the same bench as item no. 102 in the regular list and Sr. Adv. Indira Jai Singh appearing as petitioner-in-person mentioned the matter for a short adjournment since she had personal difficulty on the date of listing. The Court said that if tomorrow the matter is not taken up it has to go in the month of January.
