Special NIA Court Cancels Bailable Warrant for BJP MP Pragya Singh Thakur in Malegaon Blast Case

The bailable warrant issued against BJP MP Pragya Singh Thakur, a prime accused in the Malegaon 2008 blast case, was revoked by the Special NIA Court on Friday following her appearance before the court.

Special Judge AK Lahoti had issued the warrant due to Thakur's persistent non-appearance in the case. However, the court temporarily halted the warrant upon learning that she was hospitalized in Mumbai and the NIA officers had not yet served the warrant on her.

Thakur made her appearance before the court on Friday at 2:50 PM. Her advocate, Prashant Maggu, submitted an application requesting the cancellation of the warrant.

After reviewing Thakur's medical documents citing her "ill-health," the court decided to cancel the bailable warrant. Following this, Maggu submitted a second application requesting a rescheduled date for recording her accused statement under Section 313 of the CrPC. The application stated:

In compliance with the request, the court instructed Thakur to appear on March 28, 2024. The Malegaon blast, which took place on September 29, 2008, led to six deaths and over 100 injuries when an explosive device planted on a motorcycle exploded near a mosque in the town of Malegaon, situated about 200 km north of Mumbai in Maharashtra.

Initially, the Maharashtra Anti-Terrorism Squad conducted the investigation into the case, but it was subsequently transferred to the NIA in 2011. Pragya Singh Thakur, who presently serves as a BJP Member of Parliament from Bhopal, is one of the accused in the case.

Thakur, along with six co-accused individuals, is undergoing trial in the case, facing charges under multiple sections of the Indian Penal Code (IPC), the Unlawful Activities Prevention Act (UAPA), the Explosive Substances Act, the Indian Arms Act, and the Maharashtra Control of Organised Crime Act. Presently, the court is in the process of recording the statements of the accused under Section 313 of the Code of Criminal Procedure (CrPC).
