Bail denied to Siddique Kappan in PMLA Case by Lucknow Court

On Monday, October 31, 2022, Lucknow Sessions Court denied bail to Kerala journalist Siddique Kappan in connection with a Prevention of Money Laundering Act (PMLA) case filed by the Enforcement Directorate against him (ED). The rejection of his bail plea means he will remain in jail despite being granted bail in other cases by the Supreme Court in September 2022. On October 12, District Judge Sanjay Shankar Pandey adjourned the case and reserved the decision.

The Supreme Court granted bail to Kappan on 09th September 2022, after he had been detained by UP Police since 06th October 2020, in connection with the Hathras Conspiracy case. The order was issued by a bench comprising of Chief Justice of India U.U. Lalit and Justice S. Ravindra Bhat while hearing Kappan's appeal against the Allahabad High Court's order denying him bail. Following the gangrape-murder of a Dalit minor girl in Hathras, Kappan was detained for alleged offences under Sections 17 and 18 of the UAPA; Sections 120B, 153A/295A IPC; and Sections 65 and 72 of the IT Act for alleged conspiracy to incite riots.

Kappan, a reporter for the Malayalam news portal Azhimukham and the secretary of the Delhi unit of the Kerala Union of Working Journalists (KUWJ), was arrested in Uttar Pradesh with three others in October 2020, while on his way to Hathras to report on the gangrape and murder of a 19-year-old Dalit girl.
