The Delhi High Court in its important judgment said that lawyers should be given complete freedom to present their case before the court. If he does not speak in the court, then what will he do? It is their right to argue. If we start looking into such petitions, then it will become a joke. During the trial, the lawyers should present their case boldly and with authority. For that, they should argue with impunity.

Justice Mini Pushkarna said in her judgment that "lawyers have all kinds of freedom to present their case. If the lawyers are affected by defamation or any other threat, then they will be afraid to cross-examine them. How can justice be done in such a situation? Lawyers have the right to present their case forcefully in front of the court. Defamation cannot be claimed against him for speaking in court. He said that we also have to see that no action is taken against any lawyer for the things spoken during the trial".

The Delhi High Court said that if we start examining the statements of the lawyers during such hearings, the judiciary will go down. A fear will inculcate within the lawyers that if they say something, there may be a claim against them. In such a situation, he would hesitate to even speak his mind. Then there will be no cross-examination in the court.

Actually, during the hearing of a case, the businessman was called to the court. The businessman was uprooted by the questions asked by the other side's lawyer. After the hearing was over, he prepared a defamation claim of two crores with his lawyer and took it to the Delhi High Court. He said that the lawyer had tarnished his reputation in the open court. Therefore, it is necessary to take strict action against him.
