Karnataka High Court has sternly reprimanded the State government for its failure to provide proper toilet and drinking water facilities in schools across Karnataka. The Court, expressing deep displeasure, emphasized the urgent need for action to address this critical issue that directly affects the educational opportunities of students in the state.

During the hearing of the case titled "Registrar (Judicial) v The Chief Secretary," a bench comprising Chief Justice PB Varale and Justice MGS Kamal expressed concern that the absence of essential infrastructure in schools could deprive even the most talented students of the chance to contribute to the progress of the State and the country.

The Court remarked on the distressing situation, stating, "This really pains us. Last time also we observed that, on one hand, there are fortunate individuals who have access to schools equipped with modern technology, gadgets, and clean water. However, due to this callous approach, the dream of sending their children to such schools becomes unattainable for poor parents."

In response to these shortcomings, the Court directed the government to conduct a comprehensive survey across schools in the State to determine the availability of toilets and drinking water facilities. The Court further instructed the government to rectify any deficiencies within two weeks, emphasizing the need for prompt action.

The order was issued subsequent to a report submitted by the Amicus Curiae, who was appointed to investigate reported violations of children's fundamental right to primary education. After examining images and reports presented by the education department, the Court discovered numerous deficiencies in the infrastructural facilities of the schools.

The Court expressed its dismay, noting that the facilities provided were far from meeting the required standards and were merely "namesake" facilities. It criticized the poor condition of toilet blocks, highlighted the lack of differentiation between toilets for boys and girls in photographs, and raised concerns about the dilapidated state of the facilities.

In one particularly distressing instance, it was revealed that an attendant was manually carrying water on their head for drinking and cleaning purposes at one of the schools. The Court strongly condemned such a casual approach and urged the authorities to demonstrate seriousness and genuine concern while addressing the issue, requesting that they refrain from defending the indefensible.

Consequently, the Court adjourned the case for three months to allow for the submission of a fresh survey report. The case serves as a crucial reminder of the pressing need for improved infrastructure in schools, as the lack of basic amenities severely hampers students' access to education and hinders their potential for growth and development.
