SCBA writes strong worded letters to CJI over Circulars terminating “Adjournment Request Practice”

The Lawyer’s Body of the Supreme Court has written a letter to the Chief Justice of India a very strong worded letter opposing the move of the CJI regarding the discontinuing the practice of requesting adjournment via letters of slips.

The letter written by the Secretary of the Supreme Court Bar Association Rohit Pandey says that it is an age-old practice in the Supreme Court which has been evolved by the Supreme Court after long practice.

The letter says that even in the existing system where the letters for adjournment are circulated, more than 52000 cases have been disposed of. The Supreme Court being the Court of last resort, the advocates as well as the litigants shall be given a fair opportunity to represent themselves.

SC becomes no adjournment court: Says new circular

The letter says that there are eventualities when the Judges are not sitting, and all the matters listed before the bench get adjourned. The advocates also have genuine problems and they circulate letters. Sometimes the advocates also have to engage senior advocates.

The strongly worded letter says that the registry issues lists suddenly, sometimes late hours, therefore, the letters are required to be circulated.

Pandey in his letter said that this practice of circulation of letters in advance so that the judges also do not have to read file when the adjournments are sought.

The letter says, "Further, in its letter, the SCBA also mention here that the circulars dated 5-12-2023 & 22-12-2023 issued by the  Registry discontinuing the long-standing practice of circulation for adjournment without consulting the SCBA and as a result, members are facing lot of inconveniences."

It is learnt to the TLA Network that the SCBA and SCAORA are going to mention this matter before the Chief Justice of India on Tuesday Morning when the court reopens after winter vacation.

Supreme Court Advocate-on-Record Association also wrote such a letter to the Chief Justice of India when this kind of circular was issued in the beginning of the month.
