On Wednesday, the Supreme Court directed the transfer of the investigation into the assault cases involving Bharatiya Janata Party (BJP) leader Kabir Shankar Bose to the Central Bureau of Investigation (CBI).
The investigation into the matter was initially handled by the West Bengal Police, leading Bose to approach the Court, alleging that he had been falsely implicated in the cases by Trinamool Congress MP Kalyan Banerji.
A bench of Justices Pankaj Mithal and Sandeep Mehta issued the order, granting Bose's plea.
"A writ of mandamus is issued to the state of West Bengal to hand over the investigation to CBI so that trial may commence and justice is done to parties," the Court ordered.
Singh was one of six BJP leaders who approached the Supreme Court in 2020, alleging a "witch-hunt" by the West Bengal Police under the direction of the ruling Trinamool Congress Party. They sought the transfer of all cases registered against them by the West Bengal Police to an "independent" investigating agency.
Bose, who was previously married to Trinamool Congress (TMC) leader Kalyan Banerji's daughter, claimed that following his divorce filing, multiple cases were filed against him at Banerji’s behest due to personal and political rivalry.
The criminal charges against Bose in two cases filed in December 2020 included causing hurt, criminal intimidation, and outraging the modesty of women, stemming from allegations that he assaulted TMC workers and molested a woman. Bose denied these allegations, stating that on December 6, 2020, he and his security detail were attacked and harassed by a group led by one Santosh Kumar Singh alias Pappu Singh, just outside his residence around 8 PM. Following the attack, the security personnel moved Bose to a safe location, as per protocol.
The petition further claimed that the entire building was surrounded by over 200 TMC supporters, led by Banerji, until 2 AM, with the State Police actively supporting the mob. When Bose later went to the police station, he alleged that officers repeatedly mentioned that Banerji was exerting immense pressure to have him arrested immediately. Bose was arrested at the police station.
Additionally, Bose claimed he was intentionally kept in a COVID-19 isolation ward for nearly four hours, violating his right to life under Article 21 of the Constitution.
In January 2021, the Supreme Court stayed the FIRs filed against him in 2020, and today, the Court transferred the investigation into these cases to the CBI.
