The Supreme Court agrees to hear AAP leader Manish Sisodia's pleas seeking relaxation of bail conditions that require him to report to the investigating officer twice a week in the corruption and money laundering cases related to the Delhi excise policy.
The matter will be heard on December 11.
Senior advocate Abhishek Singhvi, appearing for Sisodia, mentioned the case before a bench of Justices B R Gavai and K V Viswanathan.
"Day after tomorrow," the bench said, while agreeing to list the matter on December 11.
The Supreme Court, on November 22, agreed to hear AAP leader Manish Sisodia's pleas and issued notices to the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) seeking their responses on the applications.
On August 9, the Supreme Court had granted Sisodia bail in the corruption and money laundering cases linked to the alleged Delhi excise policy scam, noting that his 17-month-long incarceration without trial had deprived him of his right to a speedy trial. The court had imposed conditions, including that he report to the investigating officer every Monday and Thursday between 10 and 11 am.
During the November 22 hearing, Senior advocate Abhishek Singhvi, representing Sisodia, mentioned that the Aam Aadmi Party (AAP) leader had appeared before the investigating officers 60 times.
Sisodia, who was arrested by the CBI on February 26, 2023, for alleged irregularities in the formulation and implementation of the now-scrapped Delhi excise policy 2021-22, was later arrested by the ED in a related money laundering case on March 9, 2023. He resigned from the Delhi cabinet on February 28, 2023. Sisodia has denied the allegations.
In its August 9 ruling, the apex court emphasized that "bail is the rule, and jail is the exception," and pointed out that the prolonged incarceration had denied Sisodia his right to a speedy trial. The court had directed him to furnish a bail bond of ₹10 lakh with two sureties of the same amount, surrender his passport with the special court, and refrain from influencing witnesses or tampering with evidence.
The Supreme Court had set aside the May 21 decision of the Delhi High Court, which had dismissed Sisodia's bail pleas. Both the ED and the CBI had opposed his bail applications.
