Executions in two death penalty cases were stayed this week by a Supreme Court bench, which includes Chief Justices D.Y. Chandrachud, P.S. Narasimha, and J.B. Pardiwala. Furthermore, it ordered the accused's psychological evaluation in accordance with the standard established in Manoj v. State of Madhya Pradesh (Samivel and Deen Dayal Tiwari).
The Court ordered the concerned States (Tamil Nadu and Uttar Pradesh) to submit the reports of all probation officers related to Samivel and Deen Dayal within eight weeks. A report on the type of job the accused did while incarcerated was requested from the superintendent of the separate facilities. Another report regarding the conduct and demeanour of the accused throughout the previous eight weeks in custody has also been requested.
The King George Medical University in Lucknow and the Head of the Psychiatry Department at Madurai Medical College were each requested by the Apex Court to form teams to work on Samivel and Deen Dayal's psychological progress, respectively.
In Samivel's case, the Bench had given Ms. Katherine Deborah Joy of Project 39A, National Law University, Delhi access to him so that she could submit the report about the appellant's psychiatric evaluation. The concerned psychologist was granted the same permission for Deen Dayal.
