SC Slams Lawyer for Alleging Nepotism in Senior Advocate Designations

The Supreme Court on Thursday rebuked a lawyer for suggesting that the courts were designating the relatives of judges as Senior Advocates.

The remarks came during the hearing of a petition filed by advocate Matthews J. Nedumpara and others, challenging the recent designation of 70 lawyers as senior advocates by the Delhi High Court.

The bench, comprising Justice BR Gavai and Justice KV Viswanathan, was presiding over the matter.

"How many judges can you name whose offspring have been made seniors?" the Court asked as it questioned the allegations made in the petition.

In response, Nedumpara stated that he had submitted a chart to support his claim. However, the Court was not persuaded by the submission and cautioned that action would be taken if the allegations were not removed from the petition.
 
"We will grant you liberty to amend the plea and if it is not amended then we will take steps accordingly," the Court said.
 
When Nedumpara claimed that the bar was intimidated by judges, the Court took strong exception to his line of argument.
 
"This is a court of law and not azaad maidan of Bombay to make speeches. Make legal arguments and not for gallery," Justice Gavai remarked.

Ultimately, the Court granted the counsel time to reflect over the pleadings and consider whether they need to be removed.

"A lawyer who is signatory to such a petition is also guilty of contempt," it warned.

The recent designation of lawyers by the Delhi High Court has been embroiled in controversy from the outset. One member of the Permanent Committee resigned, alleging that the final list was prepared without his consent. Senior Advocate Sudhir Nandrajog, a representative of the Delhi government on the panel, did not sign the final list, which was circulated to the full court for deliberation, as he was occupied with an arbitration for two days. There were also claims that the original list had been tampered with.
