SC Slams Centre for Frivolous Appeals in Armed Forces Pension Cases

The Supreme Court criticized the Central government on Thursday for filing unwarranted appeals in cases related to disability pensions for armed forces personnel.

The Bench, consisting of Justice Abhay S. Oka and Justice Ujjal Bhuyan, urged the government to develop a policy to prevent such frivolous appeals.

"We are of the view that the Government of India must evolve a policy. There has to be some scrutiny before a decision is taken to drag members of the armed forces to the Supreme Court," the Court said.

The Court remarked that armed forces personnel who receive relief in the form of disability pensions from the Armed Forces Tribunal should not be unnecessarily dragged into court proceedings.

The Court was hearing an appeal filed by the Central government against retired Army personnel. The matter was adjourned, with the Court instructing the government to inform it about any policy decisions concerning disability pension cases.
 
"As we have given a longer date, we call upon the first appellant to disclose whether it is willing to take such a policy decision before the next date," it said
