SC Shocked as Calcutta HC Denies Bail to Man Awaiting Trial for 10 Years in Magistrate Triable Case

The Supreme Court has expressed its astonishment at the Calcutta High Court's decision to deny bail to a man in a case triable by a magistrate, despite the fact that he has been awaiting trial for ten years.

A vacation bench comprising Justice Abhay S. Oka and Justice Satish C. Sharma described it as a 'shocking state of affairs' that the court denied bail for such an extended period in this case.

"It is a magistrate-triable case. How can a person be kept in custody?", the court said.

The accused, a trustee of South Point Education Society, caught in the crossfire of the ongoing conflict between the Birla and Lodha groups, has been languishing in jail. The Court observed that this situation arose solely due to the clash between two influential private entities, reflecting a sorry state of affairs. "It is very surprising that even in a magistrate-triable case, people are not granted bail, more so when the chargesheet has already been filed as if these are some crimes against the nation", the court observed.
