The Supreme Court today resumed proceedings in the case concerning the rape and murder of a trainee doctor at RG Kar Medical College and Hospital in Kolkata.
The bench, led by Chief Justice DY Chandrachud and including Justices JB Pardiwala and Manoj Misra, made several key observations:
- "We urge health professionals to return to their duties. Once they are back at work, the court will ensure that authorities do not take any adverse actions against them."
- "Our examination of working conditions includes experiences in public hospitals. I personally have slept on the floor of a government hospital while caring for a family member. We are aware that doctors often work over 36 hours at a stretch."
- "Given the demanding nature of their duties, doctors may be physically and mentally exhausted, which can impact their ability to handle harassment or other challenges."
- "It is critical for the functioning of public health infrastructure that doctors resume their work."
- "We assure doctors that there will be no victimization upon their return."
- "In my 30 years of experience, I have not encountered a case where a state has failed to adhere to the criminal procedure code as seen in Bengal."
These remarks reflect the Court's commitment to addressing both the immediate needs of the medical professionals and the broader implications for public health.
