SC refuses to quash FIR against UP Congress leader over alleged 'Modi-Adani Love Affair’ remark

The Supreme Court of India has refused to quash the First Information Report (FIR) filed against Sachin Chaudhary, the Secretary of UP Youth Congress. Chaudhary had come under scrutiny for his alleged derogatory remarks claiming a "love affair" between Prime Minister Narendra Modi and industrialist Gautam Adani, founder, and chairman of the Adani Group.

A bench comprising Justices Aniruddha Bose and Bela M. Trivedi dismissed Chaudhary's petition, which sought to quash the FIR. The petitioner argued that the allegations made in the FIR, if true, would not constitute an offense under Section 153A (Promoting enmity between different groups) of the Indian Penal Code (IPC). However, the Supreme Court held that the investigation into the alleged offenses was ongoing, and it was not the right stage to interfere.

The case originated when Akshit Agarwal, a leader of the Bharatiya Janata Party's youth wing, filed the FIR against Chaudhary. Agarwal claimed that Chaudhary, during a press conference in Sambhal, had used derogatory language against Prime Minister Modi, insinuating a romantic relationship with Gautam Adani. The FIR was filed under Sections 153A, 505(2), and 504 IPC (Intentional insult with intent to provoke a breach of the peace).

The Allahabad High Court had previously declined to quash the FIR, asserting that the alleged offense fell within the purview of Sections 153-A and 505(2) of the IPC, which deal with promoting enmity, hatred, or ill-will between different groups and making statements that can provoke discord. Consequently, the FIR was deemed cognizable and not subject to quashing.

This case has garnered significant attention, not only due to the sensitive nature of the allegations but also because it touches on issues related to freedom of speech and expression, as well as the boundaries of political discourse.
