Today, the Supreme Court refused to entertain a writ petition seeking the registration of FIR against Justice Yashwant Varma, former Delhi High Court Judge, over the alleged discovery of illicit cash at official premises.
A bench comprising Justice Abhay Oka and Justice Ujjal Bhuyan stated that the petition, which contested the in-house inquiry conducted by a three-judge committee as per the Chief Justice of India's directions, was premature.
Justice Abhay Oka told Advocate Mathews J. Nedumpara, the petitioner:
"Mr.Nedumpara, we have seen the prayers. After the in-house inquiry is over, several options are open. CJI can direct the register of the FIR. Today it is not the time to consider this. After the in-house report, all options are open. The petition is premature."
Emphasizing the need to review judgments that protect judges from regular investigations, Nedumpara pointed out that in Kerala, the police failed to register an FIR in a POCSO case allegation against a then-sitting High Court judge.
He asserted that conducting investigations is the police's responsibility, not the court's. He further argued that the in-house committee lacks statutory authority and cannot replace a criminal investigation conducted by specialized agencies.
"Today, we cannot interfere at this stage. Let the in-house procedure be over and after that all options are open to the Chief Justice of India," Justice Oka said.
When Nedumpara again mentioned the common man's concerns, Justice Oka urged him to explain the Supreme Court's judgments on the in-house procedure and the reasons for adopting it.
Nedumpara urged the bench to admit the petition and consider the issues raised. However, the bench refused to entertain the request and dismissed the petition. As for the "wider prayers" seeking a review of the judgments in K. Veeraswami, the bench stated that it was not necessary to address that aspect at this stage.
