The case was scheduled before a Bench comprising Justice Sanjiv Khanna and Justice S.V.N. Bhatti on December 15, 2023. During the hearing, SCBA President Senior Advocate Dr. Adish Aggarwala, listed as Respondent No.1, presented arguments. This led the Court to seek assistance from a senior female member of the Bar, emphasizing the importance of diverse perspectives in addressing the issue.
Justice Khanna raised concerns during the hearing, suggesting the possibility of a private discussion or addressing the matter in chambers. The court, in its order, mandated the Registry to keep the identities of the Petitioner and Respondent No. 2 confidential. This includes a prohibition on revealing their names in cause lists or case documents. The court also encouraged the Petitioner to seek assistance from the Counselor at the Supreme Court Mediation Centre.
Respondent No. 2 was specifically directed not to share any photographs or videos of the Petitioner. Furthermore, he was instructed to avoid any form of communication with the petitioner, whether in person, via phone calls, social media, or other means.
The court directed its Registry to send the Writ Petition, along with annexures, in a sealed cover to the Gender Sensitization Internal Complaints Committee (GSICC). This committee, headed by Justice Hima Kohli, plays a crucial role in addressing gender-related issues and complaints of sexual harassment within the Supreme Court premises.
The court has decided to revisit the matter in the second week of January 2024, underscoring its commitment to a thorough examination and resolution of the sensitive issues raised in the Writ Petition.
