SC grants Permission to Late L N Mishra's Grandson to Aid Delhi HC in Historic Murder Case Appeals

The Supreme Court has granted permission to the grandson of the late L N Mishra, a former railways minister who tragically lost his life in an explosion at Bihar's Samastipur Railway Station over four decades ago. The grandson has been allowed to provide assistance to the Delhi High Court during the conclusive hearing of appeals for the individuals convicted in the murder case.

Vaibhav Mishra, a lawyer and the grandson of the deceased leader, has taken his case to the Supreme Court. He is contesting the February 7 decision of the Delhi High Court, which rejected his request for the CBI to carry out a "fair investigation" and "re-investigation."

Mishra has alleged that the investigation was mishandled, and he is seeking a fresh investigation on the grounds that the true culprits were acquitted, resulting in a "miscarriage of justice.

The experienced Congress leader and senior cabinet minister suffered fatal injuries in a grenade explosion at Samastipur while attending the inauguration of a new project.

He was transported from Samastipur to Danapur for medical treatment, but unfortunately, he passed away due to his injuries on the morning of January 3, 1975. In addition to Mishra, the explosion also claimed the lives of Surya Narayan Jha, who was a Member of the Legislative Council (MLC) at the time, and Ram Kishore Prasad Singh, a railway clerk.

A bench consisting of Justices Surya Kant and Dipankar Datta acknowledged Mishra's submissions but declined to entertain his request for a new investigation into the case. Nevertheless, they granted him permission to assist the Delhi High Court in the proceedings related to the appeals of the convicted individuals.

“After arguing the case for some time, learned counsel for the petitioner seeks and is permitted to withdraw this petition with liberty to assist the division bench of Delhi High Court at the time of final hearing of the criminal appeals filed by the convicts, in accordance with law,”

Mishra had filed two petitions in the high court in the case. In 2021, the first petition was filed in the high court seeking a direction to the CBI to consider his representation of November 5, 2020 for re-investigation.

The high court had allowed Mishra to give a representation to the CBI which responded to him on September 15, 2021.
