SC Grants Bail to Former Rajasthan BJP MLA Girraj Singh Malinga in 2022 Assault Case

The Supreme Court has recently granted bail to Girraj Singh Malinga, a former Rajasthan MLA and BJP leader, in connection with a 2022 case where he was accused of assaulting an assistant engineer from the state's electricity department.

Girraj Singh Malinga moved the Supreme Court seeking relief after the Rajasthan High Court in July this year revoked the bail previously granted to him in 2022. 

On December 13, a bench comprising Justices MM Sundresh and Aravind Kumar overturned the High Court's order, reinstating Malinga's bail.

The Bench, while reinstating Malinga's bail, considered several factors, including his compliance with the Supreme Court's directive to surrender before the authorities.

"Considering the above, we are inclined to set aside the impugned order, especially when the appellant has surrendered himself, pursuant to the observation made by us on the earlier occasion. Thus, taking into consideration the facts and circumstances of the case, we are inclined to set aside the impugned order," it said.

The Supreme Court also observed that the Rajasthan High Court had revoked Malinga's bail after a span of two years. Taking this into account, the apex court reinstated the bail granted to him.

"The appellant shall be released forthwith on the very same terms and conditions based on which he was granted bail," the Court added.

Senior Advocate Mukul Rohtagi, advocates Ajit Sharma, Aditya Vikram Singh, Sameer Rohtagi, Kanchan Kumar, Akshat Sharma, Amrit Pradhan, Yuvarajsing Solnki, Aditya Mishra, Ravi Pachori, Anshuman Singh, Mishra Aditya and Priyansh Jain, appeared for Malinga.

Additional Advocate General Shiv Mangal Sharma, advocates Amogh Bansal and Nidhi Jaswal, appeared for State of Rajasthan.
