SC Dismisses Appeal on Disability Representation in Film "Aankh Micholi"

In a recent ruling, the Supreme Court rejected an appeal regarding the portrayal of persons with disabilities in the film "Aankh Micholi."

The appellant, founder of an organization advocating for disability awareness, argued that the film perpetuated negative stereotypes, suggesting that individuals with disabilities should hide their impairments to find a partner.

The High Court had previously dismissed the case, emphasizing that the film's message focused on overcoming challenges rather than disparaging individuals with disabilities.

The Supreme Court noted that while creative freedom is protected under Article 19(1)(a), it does not extend to misrepresenting marginalized groups. The court reinforced the need for responsible representation, stating that media should avoid stigmatising portrayals that emphasize vulnerability over social aspects of disability.

Ultimately, the Supreme Court upheld the High Court's decision, affirming that the film's depiction did not warrant further restrictions beyond constitutional provisions.
