SC Directs Wikipedia to Remove Identity of Rape Victim in Kolkata Hospital Case

The Supreme Court has directed Wikipedia to promptly remove both the name and photograph of the trainee doctor who was tragically raped and murdered last month at a Kolkata government hospital. This directive is in line with Indian laws that prohibit the identification of rape victims.

Chief Justice of India DY Chandrachud emphasized that the law mandates strict confidentiality regarding the identity of victims in such cases. "The victim's identity must remain undisclosed in any form. Wikipedia must immediately eliminate any content that reveals her identity or displays her photograph," the Chief Justice stated.

The court's ruling follows earlier orders for the removal of the victim's name, images, and videos from social media platforms. The Chief Justice noted that revealing the identity of a sexual assault victim constitutes a breach of the Supreme Court's guidelines established in the Nipun Saxena case.

In its 2018 judgment in the Nipun Saxena case, the Supreme Court asserted that no person or entity may publish or broadcast the victim's name or any information that could lead to her identification.

The trainee doctor was discovered deceased with severe injuries on the morning of August 9 at RG Kar Medical College and Hospital in Kolkata. Her death prompted widespread strikes by doctors and protests nationwide. Arrests have been made, including that of a civic volunteer, the college's former principal Sandip Ghosh, and a police officer.

The CBI, which took over the investigation from Kolkata Police, has alleged attempts to tamper with evidence by the principal and the police officer. Additionally, the Mamata Banerjee government has agreed to remove the Kolkata Police chief and two officials from the health department, addressing key demands from the protesting junior doctors
