SC directs states to offer counseling to child victims of sexual offenses and ensure their education

The Supreme Court has emphasized that in cases of child sexual assault, the State or Legal Services Authorities must guarantee access to counseling from a qualified child counselor or child psychologist. This measure is crucial to aid victimized children in recovering from their trauma, ultimately enabling them to build a brighter future.

"Perhaps the rehabilitation of the girl victims in life should be part of the “Beti Bachao Beti Padhao” campaign of the Central Government. As a welfare State, it will be the duty of the Government to do so. We are directing that the copies of this judgment should be sent to the Secretaries of the concerned departments of the State." the bench added.

The Court instructed its Registry to send a copy of this judgment to the Secretary of the Ministry of Women and Child Development in the Central Government, facilitating the government's action in response to the observations mentioned above.

These observations were articulated by the bench in its judgment, which addressed an appeal presented by the State of Rajasthan High Court. The appeal challenged an order from the Rajasthan High Court that had reduced the sentence for a convict who had been initially sentenced to life imprisonment for the rape of a girl child, reducing it to twelve years. 

The Supreme Court, however, did not reinstate the life sentence imposed by the trial court. Instead, it directed that the convict serves a 14-year sentence without the possibility of remission. The Court took into consideration the young age of the accused, who was 22 years old, as one of the mitigating factors in its decision.

Furthermore, the Court issued a directive to the Secretary of the Rajasthan State Legal Services Authority, mandating the prompt disbursement of compensation to the victim under the appropriate victim compensation scheme, in accordance with her entitlement, if such compensation had not yet been disbursed.
