The Supreme Court emphasized today that bail applications should not face unnecessary delays. They expressed optimism that the Delhi High Court would promptly decide the default bail plea of Aam Aadmi Party (AAP) leader Satyendar Jain.
Justices Manoj Misra and SVN Bhatti, constituting a Vacation Bench, were hearing Jain's appeal against the Delhi High Court's decision on May 28 to adjourn his default bail plea until July 09, 2024, while issuing a notice.
Initially, the bench inquired Senior Advocate Dr. AM Singhvi, representing Jain, about the contested order. Singhvi acknowledged that the issue at hand primarily concerned a adjournment order. However, he argued that the High Court's decision to adjourn for six weeks was excessive.
He argued that a significant legal issue had emerged in the case: whether an incomplete chargesheet could be filed by the investigating agency to prevent the granting of default bail. He informed the bench that this issue was currently being deliberated by a three-judge bench of the Supreme Court. Therefore, he requested that Jain's petition be consolidated or tagged together with those petitions for consideration.
At this point, Justice Misra noted that since a three-judge bench was already deliberating on the legal point in question, it might not be suitable for the current two-judge bench to address the issue. He suggested that the petitioner should await the final decision of the High Court on the matter.
"This issue is under consideration before three-judge bench...because three-judge bench will examine the issue we cannot enter into the merits. So far as your case is concerned let the HC decide the same," Justice Misra said, adding that ultimately an order of adjournment was under challenge.
In March of this year, the Supreme Court, through a bench comprising Justices Bela M. Trivedi and Pankaj Mithal, declined to grant bail to him and simultaneously revoked his interim bail, instructing him to surrender immediately.
