On January 16, a Supreme Court division bench led by Chief Justice DY Chandrachud and Justice PS Narasimha directed the National Green Tribunal to allow Justice Sheo Kumar Singh to serve as a member of the tribunal until the process of selecting Judicial Members was completed and the new Judicial Members take charge.

Enviro Legal Defence Firm had filed an application, which was being heard by a bench. Advocate Kazi Sangay Thupden, appearing for the applicant, stated that the National Green Tribunal had 6 Judicial Members and 5 Expert Members out of a sanctioned strength of 10 Judicial Members and 10 Expert Members. Furthermore, one of the NGT members (Justice Sheo Kumar Singh) was set to leave office on January 16 2023. The bench held– "Justice Sheo Kumar Singh, shall continue to remain in office subject to his consent for continuance."

Mr Balbir Singh, Additional Solicitor General, presented a note to the bench, stating that: 
1. Steps had been taken to select Judicial Members; 
2. An advertisement was published in a national daily on December 16, 2022, and the deadline for applications was January 12, 2023.

The Petition is now scheduled for January 27, 2023.
