The Supreme Court, on Friday, denied bail to an accused in a drug-related case under the Narcotic Drugs and Psychotropic Substances Act, drawing parallels to popular TV shows Breaking Bad and Narcos.
A bench comprising Justices Bela M Trivedi and Satish Chandra Sharma referenced two widely acclaimed TV shows centered around the drug trade.
"Let me ask you, you must have seen Narcos? Very strong syndicate. Rarely caught. Another one that is must watch is Breaking Bad. You cannot fight with these people who are literally killing youth of this country," Justice Sharma remarked.
The Court was hearing an appeal against an October 4 ruling by the Delhi High Court, which had denied anticipatory bail to a married man. The man, whose alleged employee was caught with 73.80 grams of smack (heroin) in April, had sought relief. The High Court had ruled that, given the early stage of the investigation, no grounds were established for granting pre-arrest bail.
"To grant anticipatory bail in a case of this nature is not really warranted ... no recovery of contraband has been attributed to the applicants herein, however, perusal of the Status Report filed on behalf of State shows that Section 67 notices have been evaded by applicant...Besides, whether custodial interrogation is required, necessitated or not is a discretion to be exercised by the IO", it had observed.
The Supreme Court has now upheld the same.
