SC Declines to Entertain Plea Against Vehicle Scrappage Policy in Delhi-NCR

Today, the Supreme Court refused to consider a plea contesting the vehicle scrappage policy in the Delhi-NCR region. The policy, established by the National Green Tribunal (NGT), restricts the use of diesel vehicles older than ten years and petrol vehicles older than fifteen years

A division bench of Justices Abhay S. Oka and Augustine George Masih mentioned that the NGT’s guidelines cannot be contested through an interim application in an ongoing Supreme Court case.

The Court further highlighted that it had previously upheld the NGT’s directives on these restrictions, leaving no room for modification within an interlocutory proceeding.

"How can you challenge guidelines in an IA? Challenge the guidelines substantively This issue was dismissed by this court and the order was upheld by us regarding these vehicles. We cannot disturb the direction of NGT in an IA. As long as NGT order is not modified, we cannot do anything or clarify the order," the Court said.

Consequently, the Court dismissed the interlocutory application in the ongoing *MC Mehta* case, ruling that any challenge to the guidelines must be filed through separate proceedings.
 
The Court permitted the applicant to withdraw the interlocutory application, allowing them to approach the relevant authority for any challenge or clarification of the guidelines. However, it left open the option for the applicant to return to the Court if an adverse order is issued.
