SC Declines to Entertain Petition Seeking Declaration of Caste System as Unconstitutional

Today, the Supreme Court declined to consider a petition that sought to have the caste system declared unconstitutional.

The petition, filed under Article 32 of the Constitution by the Petitioner-In-Person, challenged the caste system as a violation of fundamental rights.

The matter was heard by a bench led by Chief Justice of India DY Chandrachud, which included Justices JB Pardiwala and Manoj Misra.

Refusing to entertain the petition, CJI said : "There are provisions in the constitution specifically referring to caste, to socially and educationally backward classes. The Constitution as originally drafted refers to the Scheduled Caste and Scheduled Tribes"

The bench dismissed the petition, finding it to be without merit.
