Recently, a division bench of the Supreme Court, consisting of Justices MM Sundresh and Aravind Kumar, has adjourned the bail plea filed by Jyoti Jagtap, rescheduling the hearing for August 22. This follows the court's earlier denial of interim relief and subsequent adjournment.
In May 2023, the court had issued notices on the bail pleas filed by Jyoti Jagtap and Shoma Sen, both accused in the Bhima Koregaon case. A division bench comprising Justices Aniruddha Bose and Sudhanshu Dhulia sought responses from the National Investigation Agency (NIA) and the State of Maharashtra.
Previously, in October 2022, the Bombay High Court's division bench of Justice A.S. Gadkari and Justice Milind Jadhav rejected Jagtap's bail plea. This appeal followed the Special Court’s (NIA Court) February 2022 order denying her bail application.
Jyoti Jagtap is alleged to be a member of the cultural group "Kabir Kala Manch," which organized the Elgar Parishad event in December 2017, leading to subsequent violence. The court's order highlighted her active role in organizing the event and her association with prominent members of CPI(M), a designated terrorist organization.
The court's rejection order stated, "The documents referred to herein above clearly highlight the active role of the Appellant in so far as organizing the Elgar Parishad event, but more importantly, it is the association of Appellant with the prominent members of CPI(M) which is a designated terrorist organization that cannot be lost sight of."
The division bench characterized the Elgar Parishad as part of a broader conspiracy orchestrated by CPI(M). The order further noted, "The Elgar Parishad event is thus a smaller conspiracy within the larger design and conspiracy of CPI(M) to further its agenda. From one of the letters, it is seen that there is a congratulatory message given for the success of the Elgar Parishad event and a direction is issued to exploit the death of the youth in the violence on the following day. It is also seen that CPI(M) has chalked out a detailed strategy for the furtherance of its objective to overthrow the democratically elected government of our country and the Appellant and other co-accused are prima facie actively strategizing the same."
