Former SC judge Markandey Katju wrote a letter to New Chief Justice of Pakistan

Retired judge of the Supreme Court of India Markandey Katju has written a letter to the Chief Justice of Pakistan. In his letter he has also congratulated the Chief Justice of Pakistan and has also given some suggestions.

The letter is as follows..

 

Dear Brother,

Congratulations to Honorable Qazi Faiz Isa on becoming the Chief Justice of Pakistan. I watched your swearing-in on the internet and was impressed by your good sense of asking your wife to stand with you while taking the oath.  However, I must tell you that you have to go through two tests: You have taken an oath to uphold the Constitution, which includes the fundamental rights of the citizens of Pakistan such as the right to life and liberty. As you know, after the events of May 9, a fascist reign of terror has been established by the ruling establishment in Pakistan.

Over 10,000 people, including former Prime Minister Imran Khan and many PTI leaders and workers/supporters, have been arrested, many (including women) beaten , brutally tortured, imprisoned in terrible conditions, and killed. 

Therefore, it is your duty to immediately release these 10,000 people from jail, provide them adequate compensation.

It is your duty to implement the Constitution of Pakistan because you have taken an oath to uphold it.

Article 224(2) thereof states that free and fair elections must be held within 90 days of dissolution of Parliament, and even President Arif Alvi has proposed this. It is therefore your duty to enforce Article 224(2).

If you do not successfully meet these dual criteria, your legacy within the realm of judicial history may face challenges, and your 13-month tenure as CJP could be evaluated as  unsuccessful, similar to that of your predecessor, who was hesitant in upholding his oath and primarily focused on his compensation, benefits, and retirement.
