Rakhi Sawant has decided to retract her pre-arrest bail plea, which was previously submitted to the Bombay High Court. This plea was filed in response to a case lodged against her regarding the dissemination of her ex-husband's intimate video.
The withdrawal of the petition occurred following Justice Sarang Kotval's indication that he was disinclined to grant her request.
Sawant sought recourse in the high court subsequent to the dismissal of her pre-arrest bail plea by the Sessions Court. She was charged under sections 500 (defamation) and 34 (common intention) of the Indian Penal Code, as well as Section 67A (publishing sexually explicit material in electronic form) of the Information Technology Act.
Allegations surfaced claiming that Sawant had aired the explicit video of Adil Durani on a television program. Additionally, it was claimed that Sawant disseminated the video through WhatsApp groups and shared links to it. Sawant's legal representative argued that she is dealing with several health issues and may require surgery.
He further asserted that Sawant was willing to cooperate with the investigation and argued against the necessity of custodial interrogation.
He also argued that the mentioned video was five years old and of low resolution, making it difficult to discern any details. The defense attorney emphasized that, due to its poor quality, the video lacked clarity and did not depict anything significant.
In contrast, the prosecutor asserted the necessity of Sawant's custodial interrogation. He opposed the application and informed the bench that Sawant declined to surrender her phone, citing her status as a celebrity.
