Rajya Sabha passes Telecommunications Bill 2023: A new era for communication regulation

On Thursday, the Rajya Sabha approved the Telecommunications Bill, 2023, aiming to revise and consolidate regulations concerning the advancement, growth, and operation of telecommunication services and networks. The legislation also involves amending certain sections of the Telecom Regulatory Authority of India Act (TRAI), 1997. Notably, the Lok Sabha had previously passed the bill through a voice vote on December 20, 2023.

The newly passed bill introduces stringent measures to prevent the misuse of SIM cards and mobile numbers. One key provision mandates companies to issue SIM cards only after capturing the biometric data of the user. Additionally, it outlines penalties, including a potential three-year jail term or a fine of up to Rs 50 lakh for individuals obtaining SIM cards or other telecom resources through fraudulent means, cheating, or impersonation.

Addressing national security concerns, the bill grants the government temporary control over telecom services when deemed necessary. It also provides flexibility for the government to allocate satellite spectrum through non-auction routes. In cases of public emergencies or concerns for public safety, the legislation empowers the government to take possession of a telecom network. The bill also signals the repeal of two laws, including the historic 138-year-old Indian Telegraph Act, 1885, according to Vaishnaw.

Furthermore, the legislation incorporates safeguards for telecom infrastructure, reinforcing provisions for the seamless implementation of networks, especially optical fiber cables. The government has proposed exemptions for telecom networks installed on any property, safeguarding them from potential claims, encumbrances, liquidation, or related issues associated with the property.

Additionally, the bill outlines the potential termination of spectrum assignments if the government finds that allocated spectrum remains unused without valid reasons.
