The Rajasthan High Court at Jaipur has ordered the Municipal Corporation to grant a lease (Patta) for land purchased in an auction 18 years ago within seven days. Failure to do so will result in the Director of DLB appearing before the court on May 21 to give an explanation. The decision comes as a response to the court's dissatisfaction with the delay in issuing the lease.
Single Bench of Justice Mahendra Kumar Goyal passed an interim order in a petition filed by Litigant Manoj Aggarwal. The court emphasized that there was no reason to doubt the petitioner's claims, as it was evident from the documents provided that the lease had not been issued. Despite repeated appeals over the past 18 years, the petitioner had not received the lease, despite having purchased a plot through an open auction conducted by the Municipal Corporation in 2006. Notices were issued to the Municipal Corporation for the previous hearing, but no representatives appeared in court.
Advocate Dinesh Yadav argued before the court that the petitioner had purchased a plot of about 140 square meters on RPA Road in Shastri Nagar in the open auction of the Municipal Corporation in the year 2006. The entire amount of which was deposited in the same year. Despite this, the lease of this land has not been given till now. In the last 18 years, he has appealed to the concerned Municipal Corporation officials several times to issue the lease.
On behalf of the petitioner, the court was also informed that while hearing the petition, notices were issued to the Municipal Corporation Greater for the last hearing and notices were also served on the concerned officer, but no one appeared in the court on their behalf. Hearing which, the court has asked the DLB Director to give his explanation. The Court also ordered the Director, DLB to remain present in court if the lease is not issued within a week.
