The Punjab and Haryana High Court has declined to entertain a Public Interest Litigation (PIL) seeking measures to curb illegal immigration from India to other countries, stating that the issue falls under the jurisdiction of the competent authorities.
A Division Bench comprising Chief Justice Sheel Nagu and Justice HS Grewal emphasized that government agencies should address the matter before judicial intervention.
"The concern raised pertains to rampant illegal immigration through unlawful means, violating provisions of the Emigration Act, 1983. It is appropriate for the competent authority under the Act to first examine and handle the issue before this Court considers adjudication," the Bench observed.
Consequently, the Court directed the petitioner to submit a formal representation to the authorities.
"The petitioner is instructed to submit a representation detailing all grievances within 30 days. Respondents No.1 to 3 shall consider and decide on the matter at the earliest, issuing a speaking order and communicating the outcome to the petitioner," the order stated.
The PIL, filed by Kanwar Pahul Singh, urged the establishment of Emigration Check Posts in all districts of Punjab to regulate emigration processes and take action against travel agents facilitating illegal immigration.
The case was heard amid ongoing deportations from the United States, with three US military aircraft having recently landed in Amritsar carrying deported Indian nationals. The returnees included individuals from Punjab, Haryana, Gujarat, Chandigarh, and other states.
The petitioner represented himself in court, while Additional Solicitor General Satya Pal Jain, along with Senior Panel Counsel Dheeraj Jain, appeared for the Union of India. Senior Deputy Advocate General Salil Sabhlok represented the State of Punjab.
