Today, a juvenile court in Pune ruled that the 17-year-old who drove a Porsche and struck two techies will face trial for drink driving. The court specified that he will be prosecuted and penalized in accordance with Section 185 of the Motor Vehicles Act, addressing offenses related to driving under the influence.
According to the Motor Vehicles Act, drink driving constitutes a criminal offense if a breath analyzer test indicates that the driver's blood alcohol concentration exceeds 30 mg per 100 ml.
The Motor Vehicles Act stipulates that for a first offense of drink driving, an individual can face up to six months of imprisonment along with a fine of ₹10,000. In the case of a second offense, the penalty could escalate to a maximum of two years of imprisonment and a fine of ₹15,000, a significant increase from the previous fine of ₹3,000. Additionally, repeat offenders may encounter further penalties related to the suspension or revocation of their driving licenses.
In the early hours of Sunday, tragedy struck near Kalyani Nagar in Pune as a Porsche collided with a motorcycle, resulting in the deaths of two individuals, including a young woman. The victims have been identified as Anis Awadhiya and Ashwini Costa. The devastating incident took place around 3:15 am.
The crash has ignited widespread national outrage following the teenager's release on bail within just 15 hours, under conditions that many consider to be insufficiently stringent. A local court mandated him to compose a 300-word essay on the topic of accidents, collaborate with traffic police for 15 days, and seek counseling to address his drinking habit. These conditions have drawn criticism for their perceived leniency in light of the severity of the incident.
Police stated that prior to the crash, the accused had been consuming alcohol with friends in celebration of his Class 12 results.
The chief of the Pune Police has confirmed that the 17-year-old who crashed his father's high-end Porsche was aware of the potential fatal consequences of his actions. Accordingly, the Indian Penal Code section pertaining to such circumstances will be applied in his case.
