Porsche Crash | Juvenile Justice Board Extends Remand of Minor Accused to Observation Home Until June 25

The Juvenile Justice Board in Pune has decided to extend the remand of the teenager accused of driving the Porsche involved in a fatal collision that resulted in the deaths of two engineers. The remand has been extended until June 12, 2024, with the teen being sent to an observation home.

Advocate Prashant Patil, representing the minor accused, said that the Juvenile Justice Board has ordered the minor to undergo a psychological assessment until June 25. The incident in question took place on May 19, 2024, when the 17-year-old son of a prominent Pune builder allegedly drove a Porsche Taycan while intoxicated, leading to a collision with a motorcycle in Kalyani Nagar. Tragically, two individuals lost their lives due to the accident. According to the FIR, the Porsche involved did not bear any number plates.

The FIR against the minor was registered under sections 304A (causing death by negligence), 279 (rash driving), 337 and 338 (causing hurt by endangering life), and 427 (mischief) of the IPC. He is also booked under sections 184 (driving dangerously), 119 (duty to obey traffic signs) and 177 (general provision for punishment of offences) of the Motor Vehicles Act.

Following the incident, additional sections have been invoked against the minor, including section 304 of the IPC (culpable homicide not amounting to murder) and section 185 of the Motor Vehicle Act (driving by a drunken person).

On the night of the incident, the accused and his friends reportedly consumed alcohol at Cosie and Blak establishments between 9:30 pm and 1 am. The fatal accident occurred around 3:15 am as the group of friends was returning from a party.

The Juvenile Justice Board (JJB) granted bail to the minor driver on May 19, 2023, just hours after the fatal accident. However, on May 22, 2024, the JJB modified its order and remanded the teenager accused to an observation home until June 5, 2024. The JJB also rejected the plea to try the minor accused as an adult.

The parents of the accused are currently in police custody until June 14, 2024, on charges of tampering with the blood sample of the minor accused on the night of the accident.

Earlier, a court in Pune had placed the father and grandfather of the minor in judicial custody. They were accused of pressuring their driver to take responsibility for the accident and unlawfully confining him in their residence.

The two individuals are booked under several sections of the Indian Penal Code (IPC), including:

  • Section 342 (punishment for wrongful confinement)
  • Section 365 (kidnapping or abducting with intent to wrongfully confine)
  • Section 368 (wrongfully concealing or keeping in confinement a kidnapped or abducted person)
  • Section 506 (punishment for criminal intimidation), along with Section 34 of the IPC.

The minor's grandfather was arrested on May 25, 2023, in connection with these charges.

The minor's father, a real estate developer, is additionally booked under Sections 75 and 77 of the Juvenile Justice Act. Section 75 pertains to willful neglect, while Section 77 deals with supplying intoxicating substances to a minor. It is alleged that he allowed the minor accused, who did not possess a valid driving license, to operate the vehicle and permitted him to attend a party despite being aware of his drinking habits.
