The Kerala High Court emphasized the symbolic significance of a police officer's uniform as a symbol of trust and authority, stating that it should never be used as a tool to abuse power. The court criticized a police officer who attempted to justify using derogatory language against a lawyer by attributing it to pressure and the intensity of the situation.
Justice Devan Ramachandran emphasized the importance of police officers responsibly upholding the trust placed in them.
The Court was addressing a case concerning allegations of verbal abuse against a lawyer by a police officer in Palakkad district. Today, the accused police officer submitted an affidavit, tendering an unconditional apology through his legal representative.
However, the Court expressed dissatisfaction with the police officer's affidavit, noting that it did not definitively admit or deny the allegations against him. Instead, the judge observed that the police officer vaguely stated that his actions were unintentional and occurred under pressure.
Justice Ramachandran requested clarification from the police officer's lawyer regarding whether the officer was admitting to the allegations against him.
"Tell me whether your client has said so or he has not said so. There is a clear allegation that you (police officer) used prohibitive words and vocatives against an individual who came to the police station, whatever his stature, whether he be a lawyer, or a person who is on the street, a homeless person, it doesn't matter.'', Justice Ramachandran remarked.
The judge also expressed skepticism regarding the police officer's defense, asserting that pressure and circumstances are not valid justifications for improper behavior.
The Court proceeded to caution the police officer, stating that if he fails to provide a satisfactory explanation, he would face criminal contempt of court charges.
In response, the advocate representing the police officer assured the Court that a proper affidavit would be filed. The case before the Court involves various petitions related to police conduct, including one filed by the Kerala High Court Advocate Association (KHCAA), advocating for a mechanism to expedite the adjudication of complaints against police misconduct.
The matter will be heard again on March 1.
