The Allahabad High Court has remarked that the course of justice must not be hindered by external circumstances, emphasizing that obstructing lawyers' movement during the Maha Kumbh festival disrupts the judicial process.
Justice J.J. Munir noted that a case scheduled for 10 am had to be adjourned twice because the lawyer was unable to reach the court due to severe traffic congestion in the city.
“While this Court understands that this is an unusual situation because of the presence of a large population visiting the Mahakumbh, it is the duty of the Police to ensure that movement of learned counsel to the Court is unhindered and does not affect the functioning of the Court. Any hindrance in the movement of learned counsel during Court hours impedes the process of dispensation of justice.”
The Court highlighted the need for special measures to prevent the “functioning of justice” from coming to a halt. Following these remarks, the case was adjourned for the third time.
