PIL in Bombay HC Targets Ticket Scalping After Coldplay Controversy

A Public Interest Litigation (PIL) has been filed in the Bombay High Court, requesting to impliment guidelines to address ticket scalping and the black marketing of online tickets for major events.

This legal action comes in response to the recent controversy over the sale of tickets for the Coldplay concert.

The PIL was filed by Amit Vyas, founder-partner at Vertices Partners, in light of increasing concerns regarding ticketing practices that have been worsened by advancements in technology.

A division Bench of Chief Justice D.K. Upadhyay and Justice Amit Borkar has scheduled to hear the case after the Diwali vacations, given that the issue is currently under investigation.

The Economic Offences Wing of the Mumbai Police is already looking into a complaint lodged by Vyas.

The concert, scheduled for January 18, 19, and 21, 2025, at DY Patil Stadium in Navi Mumbai, has become the center of controversy due to claims of unethical ticketing practices.

Vyas, representing aggrieved Coldplay fans across India, has lodged a formal criminal complaint with the Economic Offences Wing (EOW) in Mumbai. He accuses the online ticketing platforms of deliberately blocking legitimate buyers during the official sale, which began on September 22, allowing ticket bots and black-market operators to dominate the sales.

The complaint highlights that tickets, marked as sold out on BookMyShow, were soon found on third-party resale platforms like Viagogo at prices inflated by 30 to 50 times their original value. This raised concerns about possible collusion between BookMyShow and resellers, leading to fan outrage.

Vyas alleges that top executives at BookMyShow and Live Nation orchestrated the scam, using bots and manipulating digital queues to prevent fair access to tickets. He has called for an FIR under various sections of the Bharatiya Nyaya Sanhita, 2023, including charges of organized crime, cheating, conspiracy, and breach of trust.

"The above facts and circumstances serve as a stark reminder of the challenges facing live events in the digital age, where the joy of securing tickets to see your favorite artist can quickly turn into a frustrating and potentially costly ordeal. It also highlights the need for a robust system to ensure fair access to tickets and prevent exploitation by ticket scalpers and bots."

The PIL further calls on the relevant authorities to implement effective laws and regulations to tackle this issue.
