Advocate Vishal Tiwari filed a petition in the Supreme Court for the formation of a Judicial Commission to investigate the Morbi Bridge collapse in Gujarat, to be led by a retired Supreme Court judge. On mentioning, the CJI ordered that the case be heard on November 14.
The petition stated that "The maintenance and repairing work was delegated to a private operator that is Oreva Group who had absolutely failed in the functioning of maintenance and repairing with the absolute failure of State Government to supervise and administer the risk and suitability of such British time bridges. The State Government has failed in its duty of care of overseeing the functionality of the bridge along with its timely maintenance."
According to the petition filed, the private operator did not obtain a fitness certificate before reopening the bridge, and there was administrative oversight by government officials.
"Such shows no concern for human life and it is an utter dreadful act of violation of human rights that is the breach of right to life under Article 21 of the Constitution," the plea said.
The petitioner also requested that all states form committees to assess the risk of all old and dangerous monuments, bridges, and other structures to ensure their safety and environmental viability.
Finally, the petitioner requested the establishment of a Construction Incident Investigation Department to conduct prompt investigations in cases like this one.
After repairs and maintenance, the bridge reopened last week. However, within a short period of time, the bridge collapsed, sending people plunging into the river and eventually drowning.
