PIL Filed in Punjab and Haryana HC Challenges Appointment of New CM Nayab Singh Saini

Today, a Public Interest Litigation (PIL) was lodged in the Punjab and Haryana High Court, contesting the selection of Naya Singh Saini as the new Chief Minister of Haryana. Saini, concurrently serving as a Lok Sabha Member of Parliament for the BJP representing Kurukshetra, faces scrutiny over his appointment.

Following the resignation of former Chief Minister ML Khattar and the collective resignation of the entire cabinet yesterday, Naya Singh Saini was designated as the new Chief Minister of Haryana. However, the petition contends that Saini's status as a sitting Member of Parliament, without formally resigning from his parliamentary position, raises constitutional concerns.

Specifically, administering him the "oath of secrecy" as Chief Minister of Haryana while holding a parliamentary seat is deemed a violation of both the Constitution and the Representation of People Act, 1951, as stated in the plea.

Advocate Jagmohan Singh Bhatti has initiated legal action in the High Court, asserting that the newly formed government is deemed illegal and represents a fraudulent manipulation of democratic principles.

The plea contends that the legislative assembly comprises a total of 90 MLAs, and the appointment of Nayab Singh Saini as Chief Minister surpasses this prescribed limit, contravening the provisions of the Constitution of India. "The establishment of the Haryana government on 12.03.2024 is unlawful and null," the plea asserts.

Furthermore, the plea underscores that the newly appointed Chief Minister, Saini, does not hold a position as a Member of the Legislative Assembly (MLA) in Haryana. Consequently, it is argued that his assumption of the role constitutes deception towards the public, the Constitution of India, and the public treasury.

The plea also challenges the appointment of five cabinet ministers namely Kanwarpal Gujjar (MLA Chachrauli), Cabinet Minister, BJP leader Moolchand Sharma, Ranjit Singh (MLA independent) , JP Dalal (MLA BJP Loharu), Dr. Banwari Lal (BJP MLA Baval).

Bhatti seeks freezing of the salaries, other financial benefits and facilities provided to the Chief Minister and Cabinet Ministers.
