Today, the Patna High Court overturned the Bihar Reservation (for Scheduled Castes, Scheduled Tribes, and Other Back Classes) (Amendment) Act, 2023, as well as the Bihar (Amendment) Act, 2023 related to admissions in educational institutions.
Chief Justice K. Vinod Chandran and Justice Harish Kumar of the Division Bench were adjudicating a Public Interest Litigation (PIL) challenging the Bihar Legislature's amendment aimed at raising reservations for Backward Classes, Extremely Backward Classes, Scheduled Castes, and Scheduled Tribes from 50% to 65%.
The High Court invalidated the amendments as ultra vires and infringing upon the principle of equality enshrined in the Indian Constitution. The final verdict on the issue is still pending.
