P&H HC directs Chandigarh Police to Safeguard Family Amid Alleged Threats from BJP MP Kirron Kher

The family allegedly facing threats from BJP MP Kirron Kher has been granted one-week protection by the Chandigarh Police following the Punjab & Haryana High Court's directive.

Justice Anoop Chitkara emphasized the need for immediate protection in this unique situation, stating, "Given the circumstances of this case, it's crucial that the respective Superintendent of Police and SHO extend necessary security to the petitioner starting today for a week. Accordingly, respondent no.1 (UT of Chandigarh) is instructed to guarantee the safety of the petitioner and their family, directing the designated Superintendent of Police/SHO to ensure their security for the upcoming week."

Senior advocate Anmol Rattan Siddhu, representing the petitioner Chaittnya Aggarwal, asserted that Chaittnya's wife, Ruchika Aggarwal, along with their two minor daughters, have expressed concerns about potential threats to their safety and freedom allegedly originating from BJP MP Kirron Kher.

The petitioner claimed that he had been managing investments for Kher in the market. Due to market volatility, he faced challenges meeting some of the expected returns within the stipulated timeframe.

Additionally, the petitioner stated in the plea that Kher had issued threats of physical harm and even attempted physical assault, demanding double the owed amount. However, despite this, the petitioner has asserted that he has already repaid the dues in question.

Considering the allegations and without going into the merits of the case, the Court opined, “if this Court does not give them protection for the time being, that might amount to not exercising the constitutional jurisdiction.”

While issuing directions for protection, the Court imposed certain limitations so that the security is not “flaunted or misutilized.”

The granted protection comes with strict conditions: the petitioner and his wife are instructed not to venture beyond the confines of their residence except for essential medical needs, household requirements, or in the case of bereavement within their immediate circle of close relatives or friends, as specified by the Court.

In concluding the case, the Court stated, "This order shall remain in effect until December 19, 2023, at 2 PM."
