Orrisa HC to get 2 more judges: One Supreme Court Advocate

The Supreme Court Collegium has recommended 2 names to be appointed as Judges of the High Court of Orissa. Among them, one is Supreme Court Advocate and another is a Judicial Officer from the State of Orissa.

The Collegium Recommendation reads as under:-

The Collegium of the Supreme Court recommended the names of the following candidates for appointment as Judges of the High Court of Orissa:

1. Shri Sibo Sankar Mishra, Advocate
2. Shri Ananda Chandra Behera, Judicial Officer

The Chief Justice of the High Court of Orissa in consultation with his two senior-most colleagues made the above recommendation on 17 January 2023. The Chief Minister and the Governor of the State of Odisha have concurred in the recommendation.

At present, there is no sitting Judge in the Supreme Court who could be consulted in terms of the Memorandum of Procedure to ascertain the
suitability of the above-named candidates for elevation to the High Court.

For the purpose of assessing the merit and suitability of the above-named candidates for elevation to the High Court of Orissa, we have scrutinized and evaluated the material which has been placed on record.

1. Shri Sibo Sankar Mishra, Advocate

The candidate enrolled as an Advocate on 07 December 1991 and has a standing of 30 years at the Bar. He is specialized in civil, criminal and service law. He is an Advocate-on-record for the State of Odisha in the Supreme Court and is counsel for the Union of India and High Court of Orissa in the Supreme Court. He has a sizeable practice at the Bar which is reflected in his average professional income. The inputs received from the Government indicate that he has a good personal and professional image and nothing adverse has come to notice with regard to his
integrity.

Having regard to the above, the Collegium is of the considered view that Shri Sibo Sankar Mishra is suitable for being appointed as a Judge of the High Court of Orissa.

2. ShriAnanda Chandra Behera, Judicial Officer

Shri Ananda Chandra Behera has served as a judicial officer in various capacities in the State of Odisha. The inputs provided by the
Government in the file indicate that he has a good personal and professional image and nothing adverse has come to notice with regard
to his integrity.

Having regard to the material on record and all relevant factors, the Collegium is of the considered view that Shri Ananda Chandra Behera
is suitable for being appointed as a Judge of the High Court of Orissa.

We have also taken note of the fact that the proposal for elevation of Shri Ananda Chandra Behera, involves non-recommendation of senior judicial officers. We have duly taken note of the reasons recorded in the minutes of the Collegium of the High Court for not recommending their names. We are in agreement with the views.

In view of the above, the Collegium resolves to recommend that (1) Shri Sibo Sankar Mishra, Advocate and (2) Shri Ananda Chandra Behera,
Judicial Officer, be appointed as Judges of the High Court of Orissa. Their inter se seniority be fixed in terms of existing practice.
