Organization seeks Delhi HC approval for Ramlila maidan meeting after police revocation

An organization that purports to be dedicated to promoting public awareness about constitutional rights has filed a request with the Delhi High Court. They are seeking approval for a public gathering of approximately 10,000 individuals at Ramlila Ground later this month. This request comes after the city police withdrew their consent for the proposed event, citing concerns about it being perceived as "communal."

The request was presented for a hearing before Justice Subramonium Prasad, who indicated that he would consider the matter on the upcoming Friday.

The petitioner, known as 'Mission Save Constitution,' stated that they had engaged in a series of discussions with Delhi Police officials and obtained various approvals. Consequently, the organization was initially granted permission for the gathering scheduled for October 29.

Subsequently, according to the plea, the Deputy Commissioner of Police (DCP) of the Central Delhi district revoked the permission in a unilateral and arbitrary manner.

The plea mentioned that the petitioner's intention is to commence a series of events aimed at empowering all marginalized sections, starting with minority communities, and then extending to other communities such as Scheduled Castes (SC), Scheduled Tribes (ST), and Other Backward Classes (OBC). These gatherings and assemblies are meant to amplify the voices of all those who have been oppressed. The series is scheduled to commence with an event on October 29.

The petition has requested the court to issue an order to retrieve the letter issued by the DCP (Central) on October 16 and invalidate it. Additionally, it seeks a directive from the authorities to grant permission for the organization to conduct the event scheduled for that date.

When revoking the previously granted permission for the meeting, the letter issued by the DCP stated that, based on input from members of the public, a re-assessment was conducted. It was found that the actual theme of the event differed from what the organizer had initially presented.

The reassessment process has revealed that the language used on the posters circulating on social media related to the rally suggests that the event's agenda may have communal elements. There is a substantial concern that organizing such an event during the festive season and in such a sensitive location could potentially incite communal discord and disrupt the peace and harmony in the area, as mentioned in the letter.

The letter also noted that given the ongoing conflict between Israel and Hamas, which has created tension in Arab countries, holding such a meeting could potentially result in a law and order problem and negatively affect the communal harmony in Old Delhi, where diverse populations coexist.

The letter mentioned that considering the organizer's alleged failure to disclose the true nature of the meeting or event, the permission is being revoked and canceled immediately in the interest of maintaining law and order in the area.

According to the petition, which was filed by advocates Jatin Bhatt and Harshit Gahlot, the respondents have leveled baseless accusations and have provided unjustifiable and unrelated reasons for revoking the granted permission.

The plea stated that the organization, with advocate Mehmood Pracha as its national convenor, is dedicated to educating and raising awareness among the general public, particularly the underprivileged and disadvantaged groups, about their rights as defined in the Indian Constitution. Their mission includes utilizing the constitutional and legal provisions to alleviate the hardships and suffering experienced by these marginalized groups.
