Former Supreme Court judge Madan B. Lokur speaking at a seminar organized by the Campaign for Judicial Accountability and Reform, narrated an interesting incident related to the appointment of judges. He said that some time back a person's name was recommended from the Delhi High Court to be elevated a judge. That person used to completely abstain from alcohol but his nickname was BOOZER. IB sent the report of his drunkenness to the collegium. The collegium also raised questions on that appointment. But later that person became a judge.
Justice Madan B Lokur appreciated the collegium's move to make public the report of IB in which intelligence agencies gather information about people whose names have been proposed for judges. He said that although Law Minister Kiren Rijiju did not like this decision of the Supreme Court. But it is necessary. People have the right to know what has been the background of the person who is going to become a judge. He said that the name of the field officer of the agency should not be made public. However, the information he has collected is very important to be on the public platform.
He said that he believes Center needs to be held accountable in the matter of appointment of judges. He says that the kind of files the Center sits on is worrying. The need of the hour is that the Center should also be held accountable. Only then will the situation be rectified. The former judge said that when the recommendation to make three judges goes to the Center, it clears the names of two while withholds one. There is no reasonable logic behind the name that was stopped. The Center has to be held accountable to deal with such a situation. Only then the situation will be able to come under control.
Justice Lokur also referred to an incident of the Madras High Court, in which the Center returned the recommendation of the collegium without giving any valid reason. He said that the collegium should ask the government why they are returning their recommendations. You are answerable to the judiciary. You are also answerable to the public. Justice Lokur said that the Collegium should open the old files. The recommendations that were made in the 1990s and the first part of 2000 need to be made public. His question was that why these files have been withheld, everyone should know this. If the Collegium does not show sharp attitude, then the recommendations will keep getting stuck.
